According to prevailing law of Nepal, a marriage registration certificate may be granted on two grounds mentioned below:
a. Registering a marriage in court (“Court Marriage”) and
b. Marriage certificate issued by the ward office of local government after the marriage is performed through social and religious rites.
The prevailing law also offers the alternative of registering a marriage through the Nepali Embassy or a Consulate Office abroad, albeit this practice has not yet been implemented.
Note: In Nepal, court marriage is governed under the National Civil (Code) Act 2074 (“NCC”).It takes 2 to 3 working days to complete the court marriage in Nepal for Nepalese citizen.
The following requirements must be met in order for a court marriage to be registered in Nepal:
Step 1: Both spouses obtain the single status certificate from the appropriate ward office.
Step 2: The application is submitted to the Nepalese District Court.
Step 3: The documents will be examined by the court.
Step 4:The Court will issue the Court Marriage Certificate whenever the legal requirements have been met.
Note : (When you rent a flat outside of your hometown, you must have Temporary Residence. You must obtain a Reference for Temporary Residence from your local ward if you live outside of Kathmandu but are there for job or business and wish to obtain a marriage certificate from Kathmandu. To do this, you must submit an application to the ward office with your home owner’s name on it. To receive this reference, you must stay at your rental apartment for a minimum of 15 days.)
If someone is a foreign national, same procedure of court marriage is applied as described above. However, they must stay for at least 15 days in addition to submitting other paperwork. They need to submit additional documents which are as follows:
